For holding auctions of movable monuments, it is required issuance of licence by the competent Authority of the Ministry of Culture.

The permit is issued for a specific list of monuments to be auctioned.

The permit is personal and cannot be transferred.

The application for the auction is submitted to the competent service of the Ministry of Culture at least two (2) months before the auction.

The venue of the auction, which shall comply with all the good conservation and security standards, shall be equipped with an alarm system and be sufficiently guarded.

The applicant has suitable shop and storage areas, in cities hosting Ministry of Culture services responsible for the protection of the movable monuments of cultural heritage to be auctioned.

Auction can be organised by a) traders of modern movable monuments, b) other natural or legal persons.

The applicant has relevant professional experience, as evidenced in particular by their at least two years of involvement in the field of art auctions.

The applicant has experienced and specialised personnel.

If the auction is conducted by a legal person, a person responsible for conducting the auction is appointed, who is required to have the following formal and substantial qualifications: i) degree or diploma from a Department of any University level school in Greece or an equivalent school abroad, preferably from the Department of Archaeology or the Department of Communication, Media and Culture or ii) at least two years of employment in an enterprise organising auctions of cultural goods.

The applicant applies codes of ethics consistent with applicable law and international practices followed in conducting auctions of ancient and modern movable monuments.

The applicant is not an employee of the Ministry of Culture, or a member of recognised museums belonging to the State or to the wider public sector (has not the impediments of par.12 of article 32 of Law 3028/ 2002), has not been recognised as a monument collector and does not exercise a profession related or having been related to the protection of monuments

They provide guarantee for the fulfiment of the obligations of auction holders. Guarantee is provided by the applicant if he/she has not been irrevocably convicted for a felony or violation of legislation on the protection of cultural heritage or for forgery, bribery, theft, embezzlement or acceptance of proceeds of crime. The impediment applies for as long as there is a pending criminal prosecution. The application my be rejected is there has been a decision of suspension of the sentence imposed for one of the above acts or if the criminal prosecution for one of these acts was permanently terminated due to limitation period. If the applicant is a legal person, the impediment must not apply for members of the Board of Directors or the members of the Board.

    The particular document is included falsely in the GG 553/B/7-4-2011. Law 3028/2002 does not provide licence to possess modern monument (after the year 1830).

The order contract includes a) Clause of application of Greek law, as well as specific reference to the provisions of par. 5 and 6 of article 28 of law 3028/ 2002 b) The complete details, of both the auctioneer and the principal – seller, as well as their addresses c) The items to be auctioned with an accurate description of each d) The sale price possibly set by the principal - seller e) The place and time of the auction f) The manner and time of the transportation of the movable monument to and from the auction site g) the method of payment after the award to the highest bidder.Contract
