The lease agreement may provide that its validity is subject to the suspensive condition of the issuance of an operating license for the property to be leased. * A legal concession or legal decision to grant the property where the Center will be housed, which expressly provides for the exclusive use of the leased property to be the operation of the K.D.A.P.A.me.A.. The concession or decision to grant it may provide that their validity is subject to the suspensive condition of the issuance of an operating license for the KDAP-AMEA for the property to be granted. * Certificate of main use of the area referred to in paragraph 8 of article 107 of law 4495/2017, as well as a certificate from the competent Building Service that the said use is not prohibited by more specific provisions applicable to the specific property or the area of ​​the property. * Two complete sets of drawings from the file of the administrative act in question (building permit, approval of small-scale construction works, subordination, etc.), in which the areas are depicted in accordance with the provisions of articles 7, 8 and 9, accompanied by a technical report from a competent engineer. * Certificate of Static Adequacy, in accordance with the provisions of the ministerial decision under reference D17a/141/3/ΦΝ 275/15.12.1999 "Approval of the Greek Anti-Seismic Regulation" (B 2184). * Fire protection certificate from the competent Fire Department for the operation of the Center, in accordance with the specific provisions of Presidential Decree 41/2018 (A’ 80).

The Person in Charge must not have been irrevocably convicted of any felony or any of the misdemeanors of theft, embezzlement, fraud, extortion, forgery, defamation, counterfeiting and intentional bodily harm, breach of a drug law or of a crime against the mores and have not been deprived of his civil rights as a result of a sentence for any criminal act.

The applicant must own or rent the building of the KDAP-ΑMEA

The Center must have at least the following spaces: *a. Multipurpose room. The room must have an area of ​​at least forty-five (45) sq.m., in order to serve a maximum of fifteen (15) people, i.e. the ratio of three (3) sq.m. per person must be maintained at least . The number of people working in the room at the same time, regardless of its area, cannot exceed twenty-five (25) people. The multi-purpose room or rooms must, based on the above proportion, simultaneously cover all of the beneficiaries of each shift. The lighting of the room must be 300 LUX, and its equipment must include: ** aa. Gym mat. ** bb. Walking parallel. ** gg. Wooden wall barbell. ** dd. Stationary bike. **ee. Gym equipment. * The above minimum equipment provided for the multipurpose room does not imply a limitation of the creative employment of the beneficiaries in physical exercise and physical education activities. * b. Occupational therapy room. The occupational therapy area of ​​twenty (20) sq.m. at least includes two (2) activity development therapy tables with appropriate seats for the users and the therapist. It also includes a library and cabinets for educational and recreational material, depending on the creative employment activities practiced. * c. Specialized Personnel Office This space must be equipped with a desk, cabinets, bookcases and a conference chair. * d. Rest/Relaxation Area. In this area, there are at least two (2) beds or a bunk bed per fifteen guests of each shift and a wardrobe for storing the users personal belongings. Guests with visual and/or motor disabilities are required to be placed in single beds and not in bunk beds. * e. Meal Preparation Area. In the meal preparation area, quick meals are prepared and catering meal portions are stored, if provided. There is a refrigerator of fourteen (14) feet or more, a preparation bench measuring 1.30 x 0.60m, a sink, storage cabinets for kitchen utensils and a kitchen appliance with at least two hobs and an oven with a corresponding power supply. In this space, the creative employment of beneficiaries is allowed by engaging in related activities. * f. Special service and storage area. Wheelchairs are stored within the structure but not in the multi-purpose and occupational therapy rooms and, if possible, in a special space for this purpose. For electric wheelchairs, the possibility of charging their batteries must be provided. * g. Sanitary areas. For every fifteen (15) people, there is one (1) WC with a vestibule for people with disabilities, as specified in detail in the design instructions "Designing for All" of the Office of Studies for People with Disabilities of the Ministry of Environment and Energy, and one W.C. of a conventional type. * Since the Center has a swimming pool, the provisions of the ministerial decision under reference D12c/ΓΠ45568/1356/9.11.2020 (Β΄ 5114) apply accordingly.

The Building Permit must indicate the use of the building or space for which the permit is requested or, in any case, the use indicated on the buildings identity, in accordance with article 5 of Law 4067/2012 (A 79). * The Center must be accessible, ensuring the accessibility of the people served with motor, sensory or other disabilities. * Accessibility is defined as both horizontal and vertical access to the buildings from the street (entrances, elevator), as well as the ease of autonomous movement and use of the interior and exterior spaces of the Center, especially the sanitary areas, as well as orientation and escape in emergencies. The entrances to the Center building and the elevators must allow the entry and movement of people using wheelchairs in accordance with article 26 of Law 4067/2012 (A 79), as amended by Law 4759/2020 (A245), while in general the accessibility specifications provided for in the applicable legislation must be met.

The buildings of each Center must be located in areas within the city or settlement plan, or at a distance less than or equal to one kilometer from the city or settlement limits if they are served by regular transportation. * In any case, they must not be more than fifty (50) kilometers from a State Hospital or Health Center.

* The Center and for each operating shift employs specialized personnel who are graduates of Higher Educational Institutions (HEIs) and Higher Technological Educational Institutions (ATEIs) in Greece or holders of equivalent qualifications from foreign educational institutions in the following specialties: **a. Physical Education (HEIs), **b. Social Work (Social Worker, graduate of HEIs or HEIs or TEIs) with a license to practice. If no interest is expressed by a candidate Social Worker, a Psychologist (HEIs), Sociologist (HEIs) or graduates of Social Policy or Social Administration are hired. ** c. Occupational Therapy (University, Technical Institute or Technical Institute), with a license to practice, ** d. Caregivers-Accompanists for the Disabled (DE), ** e. Mobility, Orientation and Daily Living Skills Trainers (AEI) in the case of registered guests with visual impairment. ** The Center may also employ personnel from other scientific specialties, depending on the needs of the beneficiaries, such as Special Educators, Physiotherapists with a license to practice, Speech Therapists with a license to practice and Nurses. * In addition to the above personnel, the following may be hired: ** a. Technical Trainers (DE and graduates of OAED Schools of corresponding specialties with three years of experience in the subject). ** b. Special support staff, Social Caregivers or Welfare Supervisors or graduates of Secondary Education or IEK or graduates of compulsory education with corresponding training and/or experience in the provision of social care in disability issues. ** c. Additionally, specialists for creative employment (graduates of HEIs, ATEI or DE with certified knowledge and proven experience in subjects, such as music, theater, and visual arts). * The number of employed staff and their specialties are determined by the institution depending on the number of beneficiaries registered in the structure and the type of their disability. The ratio of staff to registered beneficiaries is at least one employee per five (5) beneficiaries. * Regardless of the capacity of the structure and the beneficiaries registered in it, at least four members of staff of par. 1 and 2 are mandatorily employed in each shift, one of whom has the status of par. b of par. 1. If the registered beneficiaries exceed twenty (20) but fall short of twenty-five (25), five (5) employees are allocated, and the proportion of staff to registered beneficiaries is calculated accordingly, when they exceed twenty-five (25). ¾ of the staff members are hired as specialized scientific personnel. * The presence of staff is mandatory throughout the structures working hours.».

The building of the KDAP- AMEA. and in the case of KDAP-AMEA that also have outdoor, unroofed areas, the boundaries of the outdoor area must be at least: *a) one hundred and fifty (150) meters from aa) areas that have been defined in the relevant urban planning as areas for hosting low and medium-disturbance productive activities in accordance with article 8 of Presidential Decree 59/2018 (A’ 114) or as areas of non-disturbing industry - crafts in accordance with article 5 of Presidential Decree of 23.2/6.3.1987 (D’ 166), bb) individual warehouses of medium nuisance, individual craft and industrial facilities of medium nuisance, ** gg) hospitals, * b) three hundred (300) meters from aa) areas that have been designated in the relevant urban planning as areas hosting high nuisance activities in accordance with article 11 of Presidential Decree 59/2018 (A’ 114) or as areas of nuisance industry - craft in accordance with article 6 of Presidential Decree of 23.2/6.3.1987 (D’ 166), bb) isolated warehouses of high nuisance and isolated artisanal and industrial installations of high nuisance, cc) areas for the treatment, storage and disposal of solid waste and areas for the treatment, disposal of solid toxic waste, dd) areas for the treatment and disposal of sewage (biological treatment), ee) casinos, * c) two hundred meters (200) from brothels, * d) distance from liquid and gaseous fuel stations at least equal to the distance specified in the relevant legislation for the establishment and operation of these stations from KDAP -AMEA and if such distance is not expressly provided for, from social welfare buildings.
