Existence of an appropriate landholding/property or a concession of use for at least 10 years from the date of submission of the application for approval of the suitability of the landholding.

Recognition of a natural resource as therapeutic.

The applicant has not been irrevocably convicted of a felony.

Submission of an environmental impact assessment for approval, which shall be submitted to the Special Department for Promotion and Licensing of Tourism Investments (EYPATE), shall be duly checked as to the suitability of the land parcel on which the spa therapy unit or spa tourism/thermalism centre will be built, and shall then be forwarded to the competent department of the Ministry of the Environment and Energy. The interested party must submit the decision approving the environmental terms within five (5) years from the date of submission to EYPATE, failing which the SOL shall be automatically revoked and the spa tourism/thermalism centre or spa therapy unit shall be sealed by decision of the head of the relevant Regional Tourism Office.

An equivalent document is a document issued by a competent judicial or administrative authority in the Member State, confirming that no conviction exists for the above offences. If there is no provision in the country of origin or provenance for the issue of a document equivalent to the extract from the criminal record, this may be replaced by a sworn statement or, in the case of states in which such documents are not issued, by a solemn declaration, submitted by the person concerned before the competent judicial or administrative authority or, where appropriate, before a notary in their country of origin or provenance, who shall issue a certificate attesting the oath or solemn declaration. The copy of the general criminal record, as well as the above documents, shall be submitted within 3 months of their date of issue. The supporting document shall be sought ex officio if it is issued by a Greek authority. To be submitted every 5 years.

4A certificate or attestation of microbiological inspection of the therapeutic natural resource used, issued by the Health Service of the relevant Regional Unit or by other accredited laboratories, in accordance with the procedure laid down after checks and sampling have been carried out, in accordance with the health provisions in force for swimming pools.Certification

The certificate shall include a microbiological inspection report at the source and at the places of use, with a specific reference to whether or not the microbes Legionella spp., Escherichia coli and Pseudomonas aeruginosa were found. Microbiological testing must have been carried out no later than 1 month before the certificate or attestation is issued.

To be submitted every 3 years. For the SOL to be issued, the managing body may submit the same certificate of physico-chemical analysis of the natural resource submitted during the recognition procedure, provided that no more than 3 years have elapsed since the certificate was granted. Managing bodies shall be granted a period of 5 months to submit a new certificate of physico-chemical analysis of a natural resource, provided that 3 years have already elapsed from the date of issue of this decision.

For spaces which have been preserved, in accordance with Articles 5 and 6 of Law 3843/2010 (Government Gazette, Series I, No 62), a copy of the application shall be kept, confirming that the procedure for preserving the site has been carried out, in accordance with Article 6(5) of Law 3843/2010 (Government Gazette, Series I, No 62). For construction or uses that are subject to the provisions of Article 24 of Law 4014/2011 (Government Gazette, Series I, No 209) and the provisions of Law 4178/2013, the certificate of completion of the procedure shall be retained, in accordance with Article 2 of Decision 41498/26.9.2011 of the Minister for Administrative Reform and e-Governance, the Minister for the Environment, Energy and Climate Change and the Minister for Justice, Transparency and Human Rights (Government Gazette, Series II, No 2167) or the certificate of payment of 30% of the total fine from the TEE IT system shall be retained. The documents referred to in the previous sentence shall also be retained in the undertaking’s records available for inspection with all the studies and plans accompanying them.

When the spa tourism/thermalism centres include thalassotherapy centres, a state or other laboratory document certifying the content of the sea water used shall also be submitted. Identification of hydrocarbons is carried out using the fluorimetric method. The sampling point is approximately 5 metres below the surface of the sea and above sea currents. The analyses shall be supplemented every 5 years by a quantitative and qualitative analysis of plankton in a 100-metre zone from the intended sampling point.

If the prescribed time limit expires, it shall be presumed that the special operating label has been issued in accordance with Article 14(4) of Law 3844/2010 ((Government Gazette, Series I, No 63), and the interested party may request a certificate to that effect from the authority competent to grant it, which must issue it.
