Description

The procedure concerns the approval for the establishment and operation of a college, and it is addressed to legal entities that have a permanent establishment in an EU Member State. Their purpose also concerns the provision of education and training services.

The registered office of the legal entity must be in an EU Member State and its purpose, according to its articles of association, must be the provision of education and training services.

Submission of an application for the approval of the establishment, along with all administrative supporting documents, except for the documents constituting or evidencing the requisite power of the legal entity, with a date of issue not exceeding the period of the previous 3 months from the submission of the application for approval. Also, where required, these must be issued in the name of the legal entity.

For the legal entity, that it has not been subject to the administrative sanction of withdrawal of approval of licence or closure of its own or another private education and training institution in the last 2 years.

The legal representative shall declare on behalf of the legal entity they represent, the distinctive title that the latter will use for the private education and training institution for which they seek the issuance of an approval.

An agreement with a foreign higher education institution recognised by the national authorities of its country and its accreditation, if required under the law of its home country.

A validation or franchising agreement of the study programmes with a foreign higher education institution recognised by the competent authorities in the country where it has its registered office, with an official translation thereof.

The legal entity must be tax compliant. This also applies in the case of an association of entities, for each legal entity.

The legal entity must be up to date with its social security obligations.

For the legal person, it must not have been declared bankrupt and it must not have filed for bankruptcy.

The legal representative of the legal entity must not have been declared bankrupt and must not have filed for bankruptcy; or a single certificate of judicial solvency or an equivalent document issued by a competent authority of the Member State, if such a document is provided for under the law of the Member State of establishment. If no such document is available, it shall be replaced by a sworn affidavit by the legal representative or, where the law of the Member State of establishment does not provide for such a sworn affidavit, by a solemn declaration made before a competent judicial or administrative authority or, where appropriate, a notary in the Member State of establishment, who shall issue a certificate stating that the sworn affidavit or solemn declaration has been made. Not required for a legal entity established under public law.

For the legal entity, a single certificate of judicial solvency or an equivalent document issued by a competent authority of the Member State, if such a document is provided for under the law of the Member State of establishment. If no such document is available, it shall be replaced by a sworn affidavit by the legal representative or, where the law of the Member State of establishment does not provide for such a sworn affidavit, by a solemn declaration made before a competent judicial or administrative authority or, where appropriate, a notary in the Member State of establishment, who shall issue a certificate stating that the sworn affidavit or solemn declaration has been made.

The legal representative of the legal entity must not have the status of a civil servant, an employee of a legal entity established under public law, a regional or local authority or of a clergyman, and must not have been subject to the administrative sanction of withdrawal of the approval/licence or closure of its own or another private education and training institution in the last 2 years. Not required for a legal entity established under public law.

The shareholders or partners or members of the management of the legal entity must not have the status of a civil servant, an employee of a regional or local authority, or of another legal entity established under public law. Not required for legal entities established under public law, legal entities in the wider public sector, and legal entities whose members or part of the members of its board of directors or their management are appointed in an ex officio capacity.

The legal representative of the legal entity must not have been irrevocably convicted of any felony or one of the misdemeanours, committed or attempted, of theft, embezzlement, fraud, extortion, forgery, counterfeiting, bribery, bodily harm, violation of provisions pertaining to drug offences or sexual offences or a crime of economic sexual exploitation, and that they have not been convicted or sentenced by a final judgment in accordance with Articles 8 and 9 of the Code of Status of Public Civil Servants (Law No 3528/2007, Α 26). Not required for a legal entity established under public law.

For the building where the college to be approved for establishment and operation will be housed, a building permit is required, approved for connection to the networks of public utilities or as specified in paragraphs 6, 7 and 8 of Article 107 of Law No 4495/2017 (A΄167), for the use of an educational institution in accordance with the provisions of the building regulation.

The study programme includes detailed content of each proposed course, a detailed timetable of courses per semester and cumulatively, with classification of the proposed courses as compulsory and optional, and as theoretical, laboratory based and mixed. Moreover, it contains a detailed programme in the form of objectives for each proposed course in terms of the knowledge, professional competences and skills to be acquired per semester of study, as well as a numerical and descriptive list of courses with the required supervisory and laboratory equipment. Finally, the study programme contains the required qualifications of instructors for teaching each course in the programme and the teaching aids (bibliography, documentation files, manuals) that students may use in each course.

An application for review of the decision, or an administrative appeal in accordance with Article 24 of Law No 2690/1999. The interested party may request either that the administrative authority which issued the act revoke or amend it (application for review), or request the authority with oversight over the one that issued it to annul it (administrative appeal).
