The articles of association must show that the legal entity has a permanent establishment in an EU Member State and that its purpose also concerns to the provision of education and training services.

If no such document is available, it shall be replaced by a sworn affidavit by the members of the governing body of the legal entity or, where the law of the Member State of establishment does not provide for such a sworn affidavit, by a solemn declaration made before a competent judicial or administrative authority or, where appropriate, a notary in the Member State of establishment, who shall issue a certificate stating that the sworn or solemn declaration has been made. The study programme includes detailed content of each proposed course, a detailed timetable of courses per semester and cumulatively, with classification of the proposed courses as compulsory and optional, and as theoretical, laboratory based and mixed. Moreover, it contains a detailed programme in the form of objectives for each proposed course in terms of the knowledge, professional competences and skills to be acquired per semester of study, as well as a numerical and descriptive list of courses with the required supervisory and laboratory equipment. Finally, the study programme contains the required qualifications of instructors for teaching each course in the programme and the teaching aids (bibliography, documentation files, manuals) that students may use in each course.
