Description

The procedure shall refer to the Operation Licence for a Summer Camp for children. This procedure shall allow for the possibility to operate a camp. The procedure shall be addressed to natural persons, legal persons, as well as public institutions.

Appointment of a person in charge. a) offences provided for in Chapter 19 of the Special Part of the Criminal Code and offences relating to the family as referred to in Articles 360 and 360A of the Criminal Code (Law 4619/2019, Government Gazette, Series I, No 95); b) crimes under Law 3500/2006 (Government Gazette, Series I, No 232) on combatting domestic violence; c) trafficking in human beings pursuant to Article 323A of the Criminal Code and Law 4251/2014 (Government Gazette, Series I, No 80); d) drug trafficking, in accordance with Law 4139/2013 (Government Gazette, Series I, No 74); e) the offences referred to in Articles 187, 187A, 187B, 299, 306, 308 to 312 and 324 of the Criminal Code.

All the works provided for at the time of issuance of the establishment licence, the construction of all permanent facilities and, in general, the development of all the operational areas of the camp must have been completed.

A building permit, or the permanent settlement of existing buildings, or a certificate of static adequacy signed by (2) engineers (every two (2) years), and a certificate pursuant to Law 4178/2013 ‘on no arbitrariness’.

Compliance with Law 4280/2014 (Government Gazette, Series I, No 159) ‘on environmental upgrade and private urban planning; sustainable development of settlements; regulations of forestry legislation and other provisions’ and, in particular, Articles 2 and 50 thereof.

A solemn declaration of an electrical engineer on the proper operation and maintenance of electrical installations.

All preventive and enforcement measures and fire safety measures provided for must be taken in the campsite areas in accordance with directives P1b/G.P.oik. 79901/2011 (Government Gazette /-- 13.7.2011) and P1b/G.P.oik. 67791/2011 (Government Gazette /-- 16.6.2011) of the Ministry of Health and the relevant orders of the Hellenic Fire Service.

Obligation to have in place a ‘Fire protection and evacuation plan for camps in the case of emergency’, for campsite managers to prepare evacuation plans (document D27/oik. 24397/989/16.7.2014 of the Family Protection Department of the Directorate-General for Welfare of the Ministry of Labour, Social Security and Welfare).

The camp must be equipped with the necessary items in order to operate in a smooth and proper manner, and be supplied with the materials to this end as specified in Article 5(6).

Compliance with the environmental licensing requirements for the project according to Law 4014/2011 and its relevant authorising provisions governing the environmental licensing procedure for projects and activities.

The camp must be staffed with the appropriate personnel, as the case may be, so that the number of officials and personnel is not lower than 20% of the number of children hosted for camps of up to 150 children. For camps hosting more than 150 children, the number of the personnel must not be lower than 17% of the number of children hosted. In camps hosting persons with disabilities, additional personnel shall be hired (compliance with Article 5(7) ‘Conditions for granting a camp operation licence’ of Joint Ministerial Decision D22/oik. 37641/1450/2016 (Government Gazette, Series II, No 2712) regarding the staffing of the camp).

There is a strict deadline to submit applications by 16 April of each year, including the management’s obligation to have the licence issued by 21 May. The operation licence shall be valid from 1 June to 30 September of each year.

    Until 16 April of each year, operators who have already received a licence to establish a camp shall submit to the competent Regional Unit an application for an operation licence, if they wish to operate their camp. The application - solemn declaration shall state the conditions provided for in Article 5 ‘Conditions for granting a camp operation licence’ of Joint Ministerial Decision D22/oik. 37641/1450/2016 (Government Gazette, Series II, No 2712), according to which: 1. a decision approving the establishment must have been issued; 2. all the works provided for at the time of issuance of the establishment licence, the construction of all permanent facilities and, in general, the development of all the operational areas of the camp must have been completed.

A copy of the criminal record of the legal representative of the legal person governed by private law, in whose name the establishment and operation licence is to be issued and of the members of the board of directors of the legal person governed by private law or of the legal representative of the institution, as well as the managers, stating that they have not been irrevocably convicted of the offences referred to in Article 7(1) of Law 4837/2021 (Government Gazette, Series I, No 178) and to any penalty for a criminal offence, and that they have not been prosecuted.

In the event that the above deadline has expired, it shall be deemed that the application of the interested party has been tacitly approved and the licence has been issued, in accordance with Article 14(4) of Law 3844/2010 (Government Gazette, Series I, No 63). In the event of tacit approval as described above, the interested party may request the issuance of the relevant certificate from the Administrative Authority competent for issuing the deed, in accordance with Article 10(4) of Law 3230/2004 (Government Gazette, Series I, No 44).
