Description

This procedure concerns the authorisation of the establishment and/or operation of a mixed or pure service station for the supply of LNG to vehicles or modification of the licence and is addressed to natural and legal persons.

The beneficiaries of a licence to establish and operate a service station (LNG) are those natural persons or members of companies entitled to a licence to establish or operate "Fuel and Energy Service Stations", in accordance with the applicable provisions. Natural persons must have reached the age of majority.

Responsible for the operation of each fuel and energy service station (as well as LNG stations) is the operator of the station or the natural person designated by him/her, in accordance with article 24 of Law 4439/2016 and article 7 of Ministerial Decision No. 188543 (Government Gazette 3368 B 2022).

The condition for natural and legal persons applying for a licence to establish and operate an LPG service station is: (i) The non conviction for violation of fuel adulteration and smuggling, subject to the provisions of Law 4177/2013 (A’183). (ii) The possession of a legal right to use and operate the land for the establishment of a pure or mixed LNG and/or L-CNG service station.

In order to obtain a licence to operate a pure or mixed service station for the supply of LNG to vehicles, it is necessary to have been issued or authorised to be established.

For the license to establish a service station it is required to meet the technical requirements of the Ministerial Decision no. 188543 (Government Gazette 3368 B 022) concerning: 1) the territorial position of and traffic connection of LNG and L-CNG service stations (art. 4) 2) the European Directives, regulations and decisions applied for LPG service stations and premises (art. 3) 3) the safety distances between the typical features of LPG service stations and /or other parts and/or buildings and/or building frames (art. 5) 4. the buildings permitted within pure or mixed LNG and/or L-CNG terminals (Article 6), 5. fire protection measures and means of fire protection for LNG and/or L-CNG terminals (Article 8).

In case the establishment of the agency falls within the scope of Joint Ministerial Decision No 172058/2016 (B 354), the declaration referred to in Article 5 of that Decision and the notification file, the prevention policy of major accidents (TBOs) and other supporting documents is required. In particular, for installations falling under JMD No 172058/2016 (B 354), etc., in Annex I, Part 2, point 18, it is stated that the threshold for the application of the lower tier requirements for a pure LNG filling station is 50 tonnes and the threshold for the application of the upper tier requirements is 200 tonnes. In the case of a mixed LNG service station, the requirements are also changed and are specified by the same Decision. In this case, the authorisation for the application of the lower tier for LNG-substances are issued after the endorsement of the Notification file, while the intervals of par. 2, of Art. 12, of Joint Ministerial Decision 188543 (FΕΚ 3368 Β 022) shall be increased in accordance with the provisions set out in par. 3, of Article 6, of the Joint Ministerial Decision No. 172058/2016 (B 354).

Payment of the fees, as laid down in Law 3054/2002 for retail-traded agencies (Article 7(3)), specified in Article 2 par. 5.a and b of YPEN/DRP/74603/1815 (LNG and/or L-CNG). It applies to mixed stations with LNG and/or L-CNG and liquid fuels. Note: (a) Not applicable to LNG and/or L-CNG stations and (b) to private-use stations.

Article 23 of the Law No 595/1984 (Government Gazette 218 A), states that natural persons or members of companies, in order to obtain authorisation for the establishment and operation of wet fuel or mixed fuel or liquid gas (LNG etc.) or purely liquid gas for public use are required to be either Greek nationals, either citizens of Member States of the European Union or the European Economic Area (EEA). Exceptionally, the granting of authorisations for the establishment and operation of a liquid fuel or mixed or purely liquefied gas service to relatives from Russia, Bosnia-Herzegovina, Turkey and Egypt, as well as the children, born by such persons.

The topographic chart must be on a scale of one to two hundred (1:200) or one to five hundred (1:500) and within a radius of fifty (50) metres from the ground or floor of the LNG station, coordinated by the State Network (ESA 87). The drawing shall indicate the plot or field of the station under establishment, the dimensions of its sides, its location with the backs of the roads, the location of the building, tanks or cylinders and pumps and distributors, the filling point of the tank or cylinder, as well as the types of the neighboring buildings. In particular, the locations of the characteristics of the station under consideration, as well as all safety distances (Article 5 of the building No 188543/2022 (B 3368) etc. are marked with the location of the service.

In the solemn declaration, under Article 8 of Law 1599/1986, of the engineer designer of the installation, it is declared that: (i) The position, where the LNG service is to be installed, is not prohibited, such use, by the applicable provisions for land use. (ii) The terms and conditions of this service are met in the case of a LNG and/or a L-CNG and in the case of a mixed service, that the conditions and conditions of point 1224/1981 or 465/1970 are met, and/or point 595/1984 and/or point 93/067/1083/2018 (B) and, where applicable, a fuel. Licence of establishment: in the event that the Licensing Authority has not approved or rejected the request, thirty (30) working days after the application for a licence of establishment, the interested party is deemed to have legally established the service station business (implied approval) and may request a relevant certificate from the Licensing Authority, in accordance with par. 4 of Article 10 of Law 10. 3230/2004 (Α΄ 44).

The same procedure shall be used to grant authorisations for the establishment of private LNG and/or L-CNG service stations. The installation of private LNG and/or L-CNG service stations must comply with the terms and conditions relating to safety issues, and the relevant authorisations shall be granted following the submission of the required documentation in accordance with the relevant provisions (Joint Ministerial Decision 188543 (Government Gazette 3368 B 2022), Articles 9 (paragraph 8), 12, 13 and 14). A pure LNG and/or L-CNG service station or a mixed LNG and/or L-CNG and liquid fuels and/or CNG service station for private use is defined as an LNG service station, which the natural or legal person having the right to operate it uses to refuel a specific use and number of wheeled vehicles, as defined in the relevant provisions (Article 9 of Joint Ministerial Decision 188543 (Government Gazette 3368 B 2022)).
