Description

The procedure concerns the announcement of the operation of a Private Vehicle Inspection Centre (I.K.T.E.O.), in the case of the transfer of the existing licence to a new owner. * More specifically, it concerns the request for the issue of a new Confirmation of Lawful Operation after the transfer of the operating licence or Confirmation of Legal Operation of the Private Vehicle Inspection Centre, by the former to the new owner. In this case, a Certificate of Legal Operation of the Private Vehicle Inspection Centre is issued under the name of the new owner.

Conditions

The data of the installation of the Private Vehicle Inspection Centre, the license of which is to be transferred to a new owner, shall not have been changed and are still in accordance with the supporting documents accompanying the existing licence, as well as the existing staff remain as declared.

A Certificate, in accordance with the ISO 9001 quality management system standard, must have been issued under the name of the new owner, by an appropriately accredited body.

The Quality Management System Certificate Private Vehicle Inspection Centre, according to ISO 9001, is issued in the name of the new owner, by an appropriate accredited institution of Greece or another Member State of the European Union. The Certificate is issued in accordance with the cases f and g, the certificate of par.1 of Article 37 of Law 2963/2001 (A268), as well as with the Circular No 20628/2206/2012 (AΔΑ: B49X1-ZCF) on Certification of Private Vehicle Inspection Centre, in particular as set out in paragraph 2 of the Certification, concerning appropriate accredited entities that can issue certification to Private Vehicle Inspection Centres.

    Title: Principle of professional freedom, abolition of unjustified restrictions on access to and exercise of professions. Article 3 provides: (a) the abolition of unjustified requirements of prior authorization for the pursuit of professions; and (b) the free exercise of professions after a period of three months following the notice of initiation accompanied by the legal supporting documents for the certification of statutory conditions, in accordance with the provisions in force on a case-by-case basis.

In particular, in paragraph 2 of the circular, a table is given with amendments to the existing provisions. Based on the circular, the requirement to establish and license the Private Vehicle Inspection Centres is deleted and shall be submitted to the competent authority.

The decision may be appealed by anyone who has a legitimate interest before the Coordinator of the Decentralised Administration of the relevant Region (until the appointment of the Supervisor of a local authority), within a period of fifteen (15) days after he/she became aware of the decision, in accordance with the provisions of Articles 227 and 238 of Law 3852/2010 (Government Gazette 87 A), as amended by Articles 118 and 131 of Law 3852/2010 (Government Gazette 87 A). The same provisions provide for an application for remedy against both the decision and the omissions of legal action by the competent bodies, by anyone with a legitimate interest, within the same period of fifteen (15) days after having taken note of it.

Remarks

*For the announcement of an operation of a Private Vehicle Inspection Centre (I.K.T.E.O.), following a transfer of the existing licence or a certificate of legal service from the former to a new owner, the competent Office shall grant a certificate of legal service issued under the name of the new owner, if the request is accompanied by all the required supporting documents and if the legal requirements are met, as provided for in par. 5 of article 8 of Joint Ministerial Decision F50/48597/5875/2009 (Β΄ 1975). For the procedure of transfer, and the corresponding templates of the application, the certificate of application and the certificate of legal operation, the provisions of the circular no. 27230/2888/2012 (ADA: B4ΛX1-KΔ) and the Joint Ministerial Decision 26640/2298/2014 (B 1302) shall apply. * In the event of a change in the details of the establishment and the declared personnel. the transfer request is rejected and the procedure of the announcement of the operation of the Private Vehicle Inspection Centre after the change is followed, as applicable.
