Remarks
Notes regarding rules of not receiving a response from the competent authority an legal consequences: *According to article 7 par. PD 38/2010, within 30 days from the receipt of the solemn declaration and the accompanying documents, the competent authority informs the provider about its decision: **a) not to check his professional qualifications, or **b) after checking his professional qualifications: (i) to require the service provider to undergo a proficiency test; or (ii) to allow the provision of services. The estimated time is extended to the following cases: * If there is any difficulty that could lead to delays in decision making, the competent authority shall inform the provider - within one (1) month - for the reason of the delay. The difficulty is re-solved within one (1) month from the said notification and the decision is finalized no later than two (2) months after the resolution of the difficulty * In the event of a material discrepancy between the providers (applicant’s) professional qualifications and the training required by Greek law, and to the extent that this discrepancy may be detrimental to public health or safety and cannot be offset by professional experience or knowledge or skills and competences acquired through lifelong learning (for which there is relevant formal validation by a competent body), the competent authority shall give the provider the opportunity to demonstrate that he/she has acquired the relevant lacking knowledge, skills and competences. The competent authority decides on this basis whether to allow the provision of services. In any case, the pro-vision of the service must be able to begin within one (1) month from the date on which the decision is taken.
