Conditions

Providers must be legally established in the State of establishment where they carry out the economic activity.

They must not have been prohibited from carrying out the relevant activities in the State of establishment, even temporarily, at the time the certificate is granted.

They must be citizens of an EU Member State.

They must be at least 18 years of age.

Remarks

Remarks on the rules on the competent authority’s failure to reply and legal consequences: Pursuant to Article 7 of Presidential Decree 38/2010, within 30 days of receipt of the declaration and the accompanying documents, the competent authority informs the provider of its decision: *a) not to check the providers professional qualifications, or *b) after verifying the service provider’s professional qualifications, (i) to require the service provider to undergo an aptitude test, or (ii) to authorise the provision of services. The estimated time is extended in the following cases: * If any issue arises that could lead to delays in decision-making, the competent authority informs the provider within one (1) month of the reason for the delay. The issue is resolved within one (1) month of the notification in question, and the decision is finalised no later than two (2) months after the issue has been resolved. * Where there is a substantial discrepancy between the provider’s professional qualifications and the training required by Greek law, and to the extent that this discrepancy may be detrimental to public health or safety and cannot be offset by professional experience or knowledge, skills and competences acquired through lifelong learning for which there is relevant formal validation by a competent body, the competent authority must provide the provider with the opportunity to demonstrate that they have acquired the knowledge, skills and competences that they lacked. The competent authority decides on this basis whether to authorise the provision of services. In any case, the provision of services may commence within one (1) month of the date on which the decision is taken. If the competent authority fails to respond within the time limits set out above, service providers may provide their services.
