The procedure concerns the notification of operation of a private language school and/or a language centre to a natural person.

Conditions

They must have reached the age of 18. This also applies to: - any natural person participating in associations of natural persons; - the legal representative or the responsible person acting for the association of natural persons

They must have a permanent establishment in an EU Member State.

They must not have the status of civil servant, employee of a legal person governed by public law, local authority or clergyman.

The operators of the economic activity must not have been convicted of any crime and must not have been convicted or sentenced by final judgment.

They must not have been dismissed from the post of civil servant or private teacher for disciplinary reasons.

They must not have been subject to administrative sanctions revoking approvals or licences or suspension of operations with regard to the same or another private education and vocational training institute within the last 2 years.

Τhey must not have been declared bankrupt and they must not have filed for bankruptcy.

The operator is required to make a Self-Declaration under Law 1599/1986, as currently in force, in which the operator must declare: (aa) their place of permanent residence (in a Member State of the European Union); (bb) that they do not have the status of civil servant, employee of a local government organisation or any other legal person governed by public law, and nor are they a member of the clergy; (cc) that they have not been subject to administrative sanctions revoking approvals or licences or suspension of operations with regard to the same or another private education and vocational training institute within the last 2 years.

A building permit with approval for connection to public utility networks or as specified in Section 107 (6), (7) and (8) of Law 4495/2017 (Government Gazette, Series I, No 167).

    A certificate confirming that the natural person has not been declared bankrupt and has not filed for bankruptcy, or applied for a Single Certificate of Judicial Solvency or an equivalent document from a competent authority of the Member State, given that such document is provided for under the law of the Member State of its establishment. If the issue of such document is not foreseen, this shall be replaced by an affidavit made by the natural person (the operator of the activity) or, where the law of the Member State of its establishment does not provide for such affidavit, by a self declaration made before a competent judicial or administrative authority or, where appropriate, before a notary in the Member State of its establishment, who shall issue a certificate verifying that the affidavit or self declaration has been made.

    Which must show that they have not been irrevocably convicted of any felony or misdemeanour, committed or attempted, including theft, embezzlement, fraud, extortion, forgery, counterfeiting, bribery, bodily harm, violation of provisions pertaining to drug offences or crimes of sexual assault or sexual exploitation for financial benefit, and, furthermore, that they have not been convicted or sentenced by final judgment, in accordance with Sections 8 and 9 of the Civil Servants’ Code (Law 3528/2007, Government Gazette, Series I, No 26).

    For private language schools and language centres where the total number of students does not exceed thirty (30) students per hour, archived fire protection studies (active and passive, if required), in accordance with the provisions of Fire Service Regulation No 13/2021 (Government Gazette, Series II, No 5519), as in force at any given time, which should be copies of those officially deposited in the e-Licences information system for the issuance of approvals; and certificates issued by the Fire Service. If a study has not been submitted via the information system, it must be obtained from the physical dossier kept by the Fire Service, or it must be an approved study kept by the operator of the activity. The operator of the activity must be provided with the records of inspection, maintenance and proper functioning of active fire protection equipment, in accordance with Fire Service Regulation No 12/2012 (Government Gazette, Series II, No 1794).

    The entire procedure concerns electronic submission of the notification. Once the notification has been submitted, the operator may start operating its activity. Upon the submission of the notification of the operation of the activity, the audit procedures carried out by the National Organisation for the Certification of Qualifications and Vocational Guidance, as the competent authority overseeing compliance with the requirements set out herein, shall commence; if the requirements are not complied with, the set penalties will be imposed.

    Remarks

    NOTIFICATION 1. It is the method by which the operator of the economic activity notifies the competent supervisory authorities of its establishment or commencement of operation of its activity and of any changes to its economic activity. 2. It is carried out by the natural person who intends to establish or operate its activity in a specific location and it is a prerequisite for its establishment or operation. The activity is established or the operation commences immediately upon the submission of the notification, without the need of a relevant authorisation.
