Description

Valid operating licence

Comply with the predictions of the operating licence and the prerequisites of the legal framework

The operating licence shall have the same duration as the concession licence. The issuance of the aforementioned operating licences is integrally linked to the use of premises, and consequently with the concession of space by the relevant port administration and operating authorities. Therefore, applications for the issuance of the licence must contain a request for the allocation of space, the examination of which chronologically precedes subsequent considerations, since the licence cannot be issued unless the concession of the site is approved.

The issuance of the operating licence shall not replace any other approvals and shall not exempt the holder of the licence from the obligation to hold licences or to comply with administrative acts provided for by other provisions relating to equipment used at the service station or parts thereof.

In order to obtain a licence to establish and operate service stations selling liquid fuel or mixed or pure liquefied gas (LPG) for public use, natural persons or members of companies are required to be either Greek nationals or citizens of Member States of the European Union or of the European Economic Area (EEA). By way of exception, a licence may be issued, on the basis of the provisions of this article on the establishment and operation of a service station for liquid fuel or mixed or pure liquefied gas (LPG), to persons of Greek origin from Russia, North Epirus, Turkey and Egypt, as well as to children born of these persons. When submitting supporting documents, persons of Greek origin from Turkey shall also present a valid Aliens Centre residence card, and the card registration number should be entered on the application form. With regard to sociétés anonymes companies with registered offices in Greece, the nationality of the shareholders shall not be considered.

For the digital submission of an application through the single public administration portal, the interested party must be a holder of TAXISnet codes.

The solemn declaration shall state the following: i. That all the terms of the establishment permit were complied with, in addition to all the terms and conditions hereof, as well as those of Presidential Decree 1224/1981 (Government Gazette, Series I, No 303), Royal Decree 465/1970 (Government Gazette, Series I, No 150), Presidential Decree 595/1984 (Government Gazette, Series I, No 218) or Ministerial Decision 93067/1083 (Government Gazette 5661, Series II, 2018), depending on the type of fuel, as applicable, without prejudice to the terms and conditions contained herein. ii. That all certificates of conformity, attestations and other documents have been checked, from which it can be presumed that the equipment and facilities of the service station comply with the requirements of the relevant national and European regulations and standards, copies of which shall also be kept in the service station file, a summary table of which is submitted. iii. That the construction works for the service station were implemented in accordance with the approved plans, the study for the allocation of explosion zones, the technical reports and the plans of the establishment permit and the building permit, as well as national and European standards and regulations. iv. All trade technicians, foremen, assistants, who were used for the construction of the service station, have, where provided for by the legislation in force and in accordance with the relevant national or European standards, the required permits or certificates evidencing their respective competence to practice their profession.

This technical service station construction file shall contain at least the following: *i. All the certificates of conformity evidencing that the equipment, electrical installations, tanks and pipe network used in the construction of the ‘port service station’ are in accordance with the applicable national and European standards and regulations. *ii. A contract with a licensed waste management body in accordance with the applicable provisions. *iii. Copies of the radiographic inspections of the tanks, as well as the non-destructive testing certificates for the tanks, in the case of existing underground fuel tanks, which document compliance with the applicable European standards and practices, as well as the hydraulic test certificate. *iv. The preventive maintenance schedule for the equipment.

More specifically: i) Where the applicant is a natural person, they shall attest: i. that, in the last eight years, they have not been subject to a final conviction for fuel fraud and have not been convicted of fuel smuggling in a court of first instance, without prejudice to the provisions of Law 4177/2013 (Government Gazette, Series I, No 173), as in force; ii. that they have a legal right to use and operate the ‘port service station’; iii. that the service station installations are in accordance with the technical descriptions and plans that accompany the establishment permit and the building permit, and no changes have taken place in the service station installations or the capacity of the fuel tanks. iv. Where the applicant is a legal person, their legal representative shall attest: i. that, in the last eight years, they themselves have not been subject to a final conviction and neither has the legal person they represent been found to have joint civil liability, of fuel adulteration; that they themselves have not been convicted in a court of first instance and neither has the legal person they represent been found to have joint civil liability, of fuel trafficking, without prejudice to the provisions of Law 4177/2013 (Government Gazette Series I No 173), as in force. ii. that they have a legal right to use and operate the ‘port service station’; iii. that the service station installations are in accordance with the technical descriptions and plans that accompany the establishment permit and the building permit, and no changes have taken place in the service station installations or the capacity of the fuel tanks.

1. An appeal may be lodged against this decision by any person with a legitimate interest before the coordinator of the Decentralised Administration concerned, within fifteen (15) days of their becoming aware of the decision, in accordance with Articles 227 and 228 of Law 3852/2010 (Government Gazette, Series I, No 87). 2. Any person with a legitimate interest may lodge an appeal with the body which issued the decision, within (15) days of their becoming aware of said decision, as per Article 118 of Law 4558/2018 (Government Gazette, Series I, No 133).

Remarks

# Amendment of Operating Licence: When, after the issuance of an operating licence, changes to certain details of the establishment of a ‘port service station’ are required, or an extension is made with facilities provided for under the provisions of Joint Ministerial Decision No 33180/351/23-4-2021 (Government Gazette Series II No 1454/2019). Refer to Steps 7, 8, 9 and 10 which refer to the procedure for the issue or amendment of a licence to operate a service station within a port zone or in tourist ports. # If there is evidence that further operation of a ‘port service station’ is not possible, the licensing authority may temporarily or definitively prohibit the continued operation of the ‘port service station’ by means of a special reasoned decision. # The licence to operate a ‘port service station’ may be temporarily withdrawn until the deficiencies are remedied, if it is found that the conditions under which it was granted cease to exist, or it may be definitively withdrawn under a fully reasoned decision issued by the authority which granted it in the first instance. # The issuance or withdrawal of the operating licence for the ‘port service station’ shall be duly notified to the applicant, the competent department of the Ministry of Environment and Energy, the local Port Authority, the local Police Department, the relevant Fire Department, the local Tax Office, the relevant Regional Directorate of Development and the competent department responsible for keeping the Independent Authority for Public Revenue system register of inflows and outflows hosted by the General Secretariat for Information Systems. The aforementioned Administrative Acts shall be published in accordance with the provisions of Law 3861/2010 (Government Gazette Series I No 112). # Before the expiry of any certificate, the licensee is required to submit a new valid document in order to continue operating to the competent department of the authority. In this case, a new operating licence will not be issued, and the service station file record will be updated with the new supporting document. The monitoring by the licensing authority is limited exclusively to the new supporting document submitted. If it is found that a ‘port service station’ is operating without any valid certificates submitted as supporting documents, the operating licence shall be withdrawn and the service station premises will be sealed.
