Description

The procedure concerns the approval of the establishment and operation of a college and is addressed to natural persons who have a permanent establishment in an EU Member State and whose purpose is also to provide education and training services.

Conditions

The natural person must not have been subject to administrative sanctions revoking approvals or licences or suspension of operations with regard to the same or another private education and vocational training institute within the last 2 years.

Submission of an application for approval of establishment with all administrative supporting documents of the natural person, bearing dates of issue not more than 3 months prior to the date of submission of the application for approval.

The natural person must have reached the age of 18.

The natural person must have their place of permanent residence in a Member State of the European Union

The natural person must not have the status of civil servant, employee of a local government organisation or any other legal entity under public law, or be a member of the clergy.

The natural person must not have been declared bankrupt and must not have filed for bankruptcy, or have applied for a single certificate of judicial solvency or an equivalent document from a competent authority of the Member State, given that such document is provided for by the laws of the Member State of establishment. If the issue of such document is not foreseen, this shall be replaced by a sworn affidavit from the natural person or, where the law of the Member State of establishment does not provide for such sworn affidavit, by solemn declaration made before a competent judicial or administrative authority or, where appropriate, before a notary in the Member State of establishment, who shall issue a certificate verifying that the sworn affidavit or solemn declaration has been made.

The natural person must not have been irrevocably convicted of any felony or misdemeanour, committed or attempted, including theft, embezzlement, fraud, extortion, forgery, counterfeiting, bribery, bodily harm, violation of provisions pertaining to drug offences or crimes of sexual assault or sexual exploitation for financial benefit, and furthermore they must not have been convicted or sentenced by final judgment, in accordance with Articles 8 and 9 of the Code of Conduct pertaining to Civil Servants and Employees of Legal Entities Under Public Law (Law No 3528/2007, Government Gazette, Series I, No 26).

Proof of deposit of the sum in favour of the National Organisation for the Certification of Qualifications and Vocational Guidance (EOPPEP).

An agreement with a foreign higher education institution recognised by the national authorities of its country and its accreditation, if required under the law of its home country.

A validation or franchising agreement for the study programmes with a foreign higher education institution recognised by the competent authorities in the country where it has its registered offices, officially translated

With regard to the building which is to house the college seeking establishment and operating approval, the following are required: 1) a building permit, with approval for connection to public utilities networks or as specified in Article 107(6), (7) and (8) of Law No 4495/2017 (Government Gazette, Series I, No 167) for use of an educational facility in accordance with the provisions of the building regulation. 2) Certificate verifying primary use of the premises issued by a private engineer, with attached plans indicating existing arrangements. 3) Certificate of (active) fire protection for educational building category use issued by the respective fire service.

The study programme should include a detailed curriculum for each course proposed, a detailed timetable of classes both per semester and cumulatively, with classification of the proposed courses as compulsory or elective, and as theoretical, laboratory-based (practical) or mixed. Moreover, it contains a detailed programme in the form of objectives for each proposed course in terms of the knowledge, professional competences and skills to be acquired per semester of study, as well as a numerical and descriptive list of courses with the required supervisory and laboratory equipment. Finally, the study programme contains the required qualifications of instructors for teaching each course in the programme and the teaching aids (bibliography, documentation files, manuals) that students may use in each course.
