Description

This procedure aims to authorise the operation of: # purely compressed natural gas (CNG) stations or # mixed stations of a. liquid fuels, liquefied petroleum gas (LPG) and CNG or b. LPG and CNG or c. liquid fuels and CNG for public or private use, to another individual or legal person who has been granted a licence to establish it, with or without charging devices for electric vehicle batteries (recharging points), by the relevant Regional Transport and Communication Services.

The establishment licence of the fuel station must have been issued.

The operation licence of a pure or mixed CNG fuel station may, if it is established at any time that the conditions under which it was granted have ceased to exist, be withdrawn temporarily until the deficiencies have been remedied or permanently, by a fully reasoned decision of the authority which granted it. In this case, the relevant regional Transport and Communications Service shall also seal the fuel stations premises in accordance with the Ministerial Decision with no. 29122/314/2019 (GG B 1485, Online Posting Number (A.D.A.): 7X7X465XΘΞ-88Ψ).

Before the expiry of any certificate, the licence holder must submit to the competent authority a new valid document for the continuation of the operation. In this case, no new licence shall be issued, but the archive of the pure or mixed CNG fuel stations liscence shall be updated with the new document. The audit of the licensing authority in this case is limited to the new document submitted. Where it is found that a pure or mixed CNG fuel station is operating without any of the certificates submitted as supporting documents being valid, the licence shall be revoced and the premises shall be sealed.

The issuance of an operating licence shall not replace other authorisations and shall not exempt the licence holder from the obligation to hold other licences or other administrative acts provided for by other provisions concerning equipment or parts of it used in a pure or mixed CNG fuel station.

Individuals or company members, are required to be either Greek citizens or citizens of member states of the European Union or the European Economic Area (EEA), in order to obtain an establishment and operation licence for a pure or mixed CNG fuel station for public use. Exceptionally, the granting of an establishment and operation licence for a pure or mixed CNG fuel station is permitted to expatriates from Russia, S. Epirus, Turkey and Egypt, as well as to children born from such persons. Expatriates from Turkey, when submitting the supporting documents, shall also show the valid residence card of the Ιmmigration Centre, after the registration number of this card has been filled in the application. For joint-stock companies having their registered office in the country, the nationality of the shareholders is not examined.

If there is evidence that shows that the further operation of the pure or mixed CNG fuel station is not possible, either because adverse traffic conditions have been created in the meantime (such as widening or differentiation of the road level, construction of a junction at a short distance) or for reasons that constitute an objective weakness of operation (such as demolition, reduction of the plot area) or due to the reasons mentioned in par. 5 of article 185 of Law 4070/2012 (GG A 82) (in the case of mixed CNG fuel station), the licensing authority may temporarily or permanently prohibit the operation of the pure or mixed CNG fuel station, with a specially reasoned decision and proceed to the sealing of its premises, in accordance with the Ministerial Decision with no. 29122/314/2019 (GG B 1485, Online Posting Number (A.D.A.): 7X7X465XΘΞ-88Ψ).

The Solemn Declaration shall include the following: (i) In the case of a pure CNG fuel station: All the conditions of the establishment licence as well as, all the terms and conditions of the relevant ministerial decision have been met. - In the case of a mixed CNG fuel station: All the terms and conditions of the relevant ministerial decision, and, where applicable according to the fuel category, of Presidential Decree (P.D.) 595/1984, as applicable, and the technical data and specifications of P.D. 1224/1981 or Royal Decree (R.D.) 465/1970, as applicable, have been met. (iii) The implementation of the construction works of the pure or mixed CNG fuel station has been carried out in accordance with the approved plans, the study of the distribution of anti-explosion zones, the technical reports and drawings of the establishment liscence and the building permit, as well as the national and European Standards and Regulations. (iv) All craftsmen, foremen, assistants involved, used in the construction of the fuel station, have, where required by the applicable legislation or by the applicable relevant national or European Standards and Regulations, the required Licences, or certificates of professional registration. 2. The digital submission of the application and supporting documents may not apply to all Regions.
9Solemn declarations of the installer of the CNG fuel stations integrated input/output system, as well as of the engineer, in accordance with the provisions in force for each fuel, stating that the software of the installed input/output system meets, without exception, the requirements of existing legislation and that its operation is proper and legal.Solemn Declaration

It shall be submitted in the case of a pure or mixed CNG fuel station, which has been granted an establishment licence without an operating licence, is transferred or leased or otherwise assigned to another person, natural or legal, the operating licence shall be granted to the new person within fifteen (15) working days from the date of submission of the application. 1. Against this decision, an appeal may be filed by anyone with a legitimate interest before the Coordinator of the relevant Decentralized Administration, within a period of fifteen (15) days after becoming aware of the decision, in accordance with the provisions of Articles 227 and 228 of Law 3852/2010 (GG A 87). 2. A request for remedy against this decision may be submitted by anyone who has a legitimate interest, within a period (15) days after becoming aware of it, before the body that issued the decision (Article 118 of Law 4558/2018 (GG Α 133). If the period of fifteen (15) working days elapses without the licensing authority approving or rejecting the request, it is deemed that the requested changes have been approved and the person concerned is legally operating his/her fuel station business without any additional restrictions. In the case of tacit approval, the applicant may request a certificate from the licensing authority in accordance with paragraph 4 of Article 10 of Law 3230/2004 (GG Α΄ 44).

# Fuel and Energy Supply Records (See Legislation tab). # If a fuel station, which has been granted an establishment licence without an operating licence, is transferred or leased or otherwise transferred to another person (natural or legal), the operating licence shall be granted to the new person within fifteen (15) working days from the date of submission of the application. # The validity of the licence for the operation of a CNG fuel station or mixed CNG fuel station shall be for an indefinite period of time. # Article 6 "Compressed natural gas (CNG) fuel stations for private use" - Joint Ministerial Decision oik. 93067/1083/2018 (GG B΄ 5661) # Proof of payment of the contributory fee for the issuance of the operating licence (see Legislation tab). For private liquid fuel stations, the document with No. DYdrog/B/F.5/171005/12-4-2018 of the Ministry of the Environment and Energy(Secretariat General for Energy and Minerals, Directorate General of Energy, Hydrocarbons Directorate, Department B’ of Hydrocarbons Organization and Market Surveillance) is applicable, which was forwarded to all the of Transport and Communications Directorates General of the country’s Regions and to all the country’s Regional Transport and Communications Services, attached to the document with No 29575/293/20-4-2018. # The issuance or revocation of the operating licence of a pure or mixed CNG fuel station shall be notified to the applicant, the competent Service of the Ministry of Environment and Energy, the local Police Department, the relevant Fire Service, the local Tax Office (D.O.Y.) and the competent Service that maintains the Register of the input-output system of the Secretariat General of Public Administrations’ Information Systems (in the case of a mixed liquid fuel and CNG station). The above administrative acts are published in accordance with the provisions of Law 3861/2010 (GG Α΄ 112).
