Remarks
Observations regarding the rules for the lack of response from the competent authority and legal consequences: Pursuant to article 7 para PD 38/2010, within 30 days at the most from receipt of the declaration and accompanying documents, the competent authority informs the provider of its decision: a) not to check his professional qualifications, or b) after checking his professional qualifications (i) to require the service provider to undergo a competency test, or (ii) to allow the provision of services. The prescribed time is extended in the following cases: - If there is any difficulty that could lead to delays in decision-making, the competent authority informs the provider within one (1) month of the reason for the delay. The difficulty is resolved within one (1) month of said notification and the decision is finalized no later than two (2) months after the resolution of the difficulty. - In the event of a substantial difference between the professional qualifications of the provider and the training required by Greek legislation, and to the extent that this difference may be harmful to public health or safety and cannot be compensated through professional experience or knowledge , skills and competences acquired through lifelong learning for which there is relevant formal validation by a competent body, the competent authority must give the provider the opportunity to demonstrate that he has acquired the knowledge, skills and competences he lacked. The competent authority makes a decision on this basis whether to allow the provision of services. In any case, the provision of service must be able to begin within one (1) month from the date on which the decision is made. If the competent authority does not react within the deadlines provided above, the service provider may continue to provide its services.
