Description

This procedure concerns the permission of the operation of an ‘LPG or mixed gas service station of public use’ to another natural or legal person authorised to establish it, with or without the charging of batteries of electric vehicles (recharge points), from their respective regional transport and communication services.

An authorisation of establishment must be issued.

The authorisation of a service station or mixed gas service station may, at any time when it is established that the conditions under which it was granted have ceased to exist, be temporarily removed until the defects have been restored, or definitively, by a fully reasoned decision of the authority which granted it.

The issue of the authorisation shall not replace any other authorisations and shall not exempt the holder of the authorisation from the obligation to issue authorisations or other administrative acts provided for in other provisions concerning equipment or parts thereof used in the service of fuel.

Before the expiry of any certificate, the holder of the licence shall be required to submit to the competent authority a new document in force for the continuation of operation; in this case, no new authorisation shall be issued, but information shall be made on the record of the agency with the new supporting document; in this case the licence holder shall be limited to the new documentation submitted and only if it is found that a service is in operation without any certificate being in force as supporting documents, the authorisation shall be withdrawn and the premises of the agency shall be sealed.

Natural persons or members of companies, in order to obtain authorisation for the establishment and operation of liquid fuel or mixed gas or purely liquefied petroleum gas service stations of public use are required to be either Greek nationals or citizens of either Member States of the European Union or the European Economic Area (EEA). In exceptional cases, the authorisation may be granted for the establishment and operation of a liquid fuel or mixed or purely liquefied petroleum gas service station to Greek nationals from Russia, North Epirus, Turkey and Egypt, as well as to children born by these persons. Turkeys counterparts at the time of submission of the documentation demonstrates even the validity of the residence card of the Centre for Immigration, after the registration number of that card has been entered in the application. For public limited companies established in the country, no account is taken of the nationality of the shareholders.

If there is evidence that the service station cannot be further operated either because, in the meantime, adverse traffic conditions have been created (such as magnification or diversification of road level, construction of node at short distances) or because of reasons which constitute an objective inability to operate (such as demolition, impairment of the ground area) or because of the reasons referred to in paragraphs 2 and 3 of Article 185 of Law 4070/2012 (A 82), the licensing authority may prohibit the continuing operation of the service by means of a specific reasoned decision.

For electronic submission via the Single Digital Portal of Public Administration, the applicant is required to hold a Taxisnet code.

Fees / Imposts

Permission of 30 €. In addition, for each pump or distributor beyond the first (1st), 30 €. It applies to a LPG or a mixed LPG and liquid fuel.

8Solemn declarations of Law 1599/1986, of the competent engineers who supervised the execution of mechanical, electrological and building facilities of the service station, which states the following: (i) “In the case of a service station, all the terms and conditions of the authorisation have been complied with, and all the conditions of the certificate, attestations and other documents substantiating the conformity of the agencys equipment and facilities with the requirements of the relevant national and European regulations and standards, copies of which are retained in the offices file, a consolidated list of which are submitted. (ii) (ii) All the conformity of the services work with the requirements of the relevant national and European regulations and standards, as well as with the relevant technical specifications, as well as with the relevant technical specifications and documentation, shall be checked. (iii) (iii) The implementation of construction works of the service station or mixed gas service station has been made according to the approved plans, the allocation of explosion-proof zones, the technical reports and the plans of the establishment approval and building permits, as well as the national and European standards and regulations. (iv) All the artisans, foremen, assistants involved that were used for the construction of the service station hold, as provided by the applicable legislation according to the relevant national or European standards, the required authorisations or announcement certifications for the execution of the business activity.”Solemn Declaration

15A solemn declaration of the applicant, in accordance with Article 8 of Law No 1599/1986. In particular: (a) In case the applicant is a natural person, he/she states under sole responsibility that: (i) during the last eight years, he/she has not been finally convicted for fuel adulteration and has not been convicted at first instance for fuel smuggling without prejudice to the provisions of Law 4177/2013, (ii) has the right to use and operate the service station or mixed gas service station, (iii) the facilities of the service station are in line with the technical standards (b) if the applicant is a legal representative of the office responsible, he/she states under sole responsibility that: (i) during the last eight years, he/she has not been finally convicted for fuel adulteration and the legal entity he/she represents has not finally been declared as jointly liable for fuel adulteration in civil law and he/she has not been convicted at first instance; (ii) that the legal entity has the right to use and operate the service station or mixed gas service station; (iii) the facilities of the service station are in line with the technical standards and the plans that accompany the establishment permit and the building permit and no change has been made concerning the facilities of the service station or mixed gas service station and the capacity of the fuel tanks.Solemn Declaration

Other An appeal may be brought against this decision by anyone who has a legitimate interest in the Coordinator of the Decentralised Administration concerned within fifteen (15) days from the notification of the decision, in accordance with Articles 227 and 228 of Law 3852/2010 (A’87).

Rules for non-response by the competent authority and legal consequences

Tacit approval

If the period of fifteen (15) working days elapses without the licensee having approved or rejected the request, the requested changes shall be deemed to have been approved and the party concerned is legally operating its business without any additional restriction. In the case of implied approval, the person concerned may request a certificate from the licensee in accordance with Article 10(4) of Law 3230/2004 (A44) and the licensee shall transmit all supporting documents for verification to the Department of Fuel and Energy Services of the Technical Control and Service of the Directorate-General for Vehicles and Facilities of the Ministry of Infrastructure and Transport.

Remarks

In case a service station that has been licensed without granting of an authorisation, is transferred or leased or otherwise granted to another person (natural or legal), its authorisation shall be granted to the new person within fifteen (15) working days from the date on which his application is submitted.
