Description

Τhe procedure relates to announcement of the commencement of sales of plant protection products (PPPs). A plant protection product shop or store is the space where producers obtain pesticides to use on their crops. This is addressed to citizens, business undertakings and legal entities.

If the application is submitted by a natural person, the person must have Greek nationality or citizenship of one of the Member States of the European Union.

If the application is submitted by a natural person, the person must not have been irrevocably sentenced to any penalty or have been indicted by irrevocable verdict for theft, embezzlement, fraud, extortion, forgery, crimes against morality, defamation and libel, counterfeiting, violation of Articles 5 and 12 of Law 1729/1987 (Government Gazette,Series I, No 144/1987), as amended, or violation of Articles 10, 14 and 46 of Law 4036/2012, or been irrevocably convicted of a crime or recurrent misdemeanour for which deprivation of their civil rights has been imposed.

The natural person or legal entity submitting the application must have a shop or store established for the sale of plant protection products (pesticides) that meets the requirements of Article 10 of Presidential Decree 159/2013 or warehouses supporting wholesale facilities selling plant protection products (pesticides) that meet the requirements of Article 11 of Presidential Decree 159/2013. BOTH of the above conditions must be met in order to carry out retail and wholesale trade in plant protection products (pesticides) from the same store. In the case of legal entities under Law 4384/2016 (Government Gazette, Series I, No 78), the above requirements must also apply to the distribution centres that the legal entity concerns maintains outside its principal place of business but within the boundaries of the region defined in its articles of association.

The legal representative of the legal entity submitting the application must not hold a salaried position in the public sector or in a legal entity governed by public or private law, nor have any other sole proprietorship requiring self-employment.

The applicant (legal or natural person) must employ, on a salaried basis, a scientist in charge who possesses the following qualifications and fulfils the following conditions: ­Greek nationality or citizenship of one of the Member States of the European Union; A university degree in agronomy or a degree in plant production or farm management from the Faculty of Agricultural Technology or the Department of Greenhouse Crops and Floriculture in the Faculty of Agriculture of a technological educational institute or an equivalent degree or diploma of equivalent specialisation from a Member State of the European Union or a non-EU country, on the basis of the principle of reciprocity. They may also be persons with equivalent training in another EU Member State on the sale of plant protection products (pesticides) and therefore able to ensure the same level of safety for humans, plant and animal health and environmental protection. The person must not have been irrevocably sentenced to any penalty or have been indicted by irrevocable verdict for theft, embezzlement, fraud, extortion, forgery, crimes against morality, defamation and libel, counterfeiting, violation of Articles 5 and 12 of Law 1729/1987 (Government Gazette, Series I, No 144/1987), as amended, as well as violation of Articles 10, 14 and 46 of Law 4036/2012 or been irrevocably convicted of a crime or recurrent misdemeanour for which deprivation of their civil rights has been imposed. ­The person must not hold a salaried position in the public sector or in a legal entity under public or private law, or have any other sole proprietorship requiring self-employment. If the natural person submitting the application meets the above conditions and is also employed in the capacity of store manager, they are not required to employ another person for this purpose. If a partner/shareholder of the legal entity meets the above requirements, the legal entity is not obliged to employ another person for this purpose. In the case of legal entities under Law 4384/2016 (Government Gazette, Series I, No 78), the above requirement must also apply to the distribution centres that the concerned legal entity maintains outside its principal place of business but within the boundaries of the region defined in its articles of association.

The copy of a foreign-language diploma or degree, which has been obtained from educational institutions in the Member States of the European Union, will be accompanied by a simple translation into Greek. In the case of a degree from an educational institution of a country that is not a member of the European Union, a certified copy of a certificate of equivalence from the Interdisciplinary Academic Recognition and Information Agency (DOATAP), or an equivalent body (NARIC) of another Member State of the European Union is required. In the case of equivalent education in another EU Member State, the documents provided for in PD 38/2010, as in force, are required for the recognition of the right to engage in the sale of plant protection products (pesticides).

The Service may prohibit exercise of the profession within a period of 90 days if the requisite legal conditions are not met or if the information submitted fails to show that they have been met. After expiry of the aforementioned deadline, it will be presumed that the profession may be freely practised (Article 3 of Law 3919/2011). In this case, the interested party may request a certificate from the relevant administrative authority (Article 10(4) of Law 3230/2004).
