Description

The procedure concerns the issuance of a Certificate of Adequacy for the temporary and occasional provision of services of a nurse/midwife/health visitor/nurse assistant/rescuer - ambulance crew, based on Article 7 of Directive 2005/36/EC on the recognition of professional qualifications. The issuing authority is obliged to send a copy of the certificate to the professional organisation concerned (for nurses, midwives and health visitors).

Conditions

Certificate issued by a competent professional authority in the Member State of establishment to the effect that the provider is lawfully pursuing his professional activities and that he is not, even temporarily, prohibited from pursuing those activities at the time the certificate is issued.

For the professions listed in Annex V - nurses/midwives: Evidence of professional qualifications: evidence of formal qualifications, in accordance with Annex V to Directive 2005/36/EC, accompanied by a certificate of conformity issued by the Member State of establishment, stating that the holders qualifications are indeed those referred to in the Directive.

A declaration regarding the applicants knowledge of the Greek language required for the exercise of the profession in Greece.

Copy of passport or identity of the provider

Certificate of absence of temporary or definitive suspensions of the professional licence or criminal convictions, in accordance with the legislation in force.

A declaration of any existing insurance guarantee or similar means of personal or collective protection covering the professional liability of the provider.

In the event of the application of a proficiency test, in accordance with par. 5 of Article 7 of PD 38/2010, any relevant expenditure shall be covered in accordance with paragraph 5 of Article 7 of PD 38/2010.

    Note
    The Declaration is submitted at the time of the first provision of services by the provider (at the first movement from a Member State to Greece to provide services and before the provision of services) or in case of a substantial change in the situation certified by the documents accompanying the first declaration. The above declaration shall be renewed once a year if the provider intends to provide services in Greece during that year.

The certificate does not constitute a prerequisite for the exercise of the right of free provision of services, which is acquired only by submitting the written declaration of article 7 par. 1 of Directive 2005/36/EC (Article 7 of Presidential Decree 38/2010) accompanied by the documents provided for in par. 2, without prejudice to the cases referred to in par. 3 and 5 of Article 7 of Presidential Decree No 38/2010. 5 (control during the first provision of services in the professions of the general system) after the time limits have expired, the services may be provided.

It concerns the temporary and occasional provision of services in Greece by professionals who are nationals of an EU member state, including Greek nationals, who are legally established in these states and have the legal qualifications for the exercise there of the professions of Annex VIII and the professions of Annex V of P.D. 38/2010 (Government Gazette 78 A) under the jurisdiction of the Ministry of Health.
