Description

This procedure concerns the announcement of the establishment of a training school for operators of speedboats or sea mopeds. It is addressed to natural and legal persons.

Stage A - The interested person (natural person or legal representative of a legal person) shall not have been irrevocably or finally convicted of the offences of intentional homicide, espionage, robbery, theft, embezzlement, fraudulent bankruptcy, smuggling, tax evasion, active or passive bribery, forgery, counterfeiting, misappropriation of funds, fraud, extortion, defamation, crime against sexual freedom, human trafficking, violation of the law on drugs and intermediaries, illegal fishing with the use of explosives or chemicals or vegetal materials or devices that produce electrical discharges, violation of mandatory law 192/1936 (A 438) and in any sentence with which even a partial deprivation of civil rights was imposed, or shall have been finally or irrevocably convicted and five years have passed since, for misdemeanours or ten years for crimes. Embedded in the Application – Solemn Declaration form of Law 1599/86.

Stage A - The applicant shall not be prosecuted as running away from trial or as a fugitive. Embedded in the Application – Solemn Declaration form of Law 1599/86.

Stage A - The applicant (natural person) shall not have been placed in a state of, nor have filed for, bankruptcy, liquidation, privative or auxiliary court wardship. In the case of a legal person it shall not be in a state of bankruptcy, bankruptcy settlement, conciliation, compulsory administration, liquidation or other similar state nor have filed in order to be placed in any of the above state.

Stage A - The interested person and the trainer hired shall be insured by the relevant insurance agency.

Stage A - Insurance policy covering the civil liability of the school owner or any servant thereof trainer or trainee against third parties for death or bodily injuries.

Stage A - The interested party shall own premises of an area of at least 25 square meters, not including the necessary auxiliary spaces, and this area shall be main use space and not part of a residence; it shall have good and sufficient lighting, sufficient ventilation and good heating,

Stage A - The interested party shall have the necessary equipment (5 seats for trainees, 1 teaching board, at least 2 lifebelts, of which one shall be equipped with a rod of cold chemical light permanently attached through a thin rope one meter long, 2 children’s lifebuoys, 2 hand sparklers, 2 red star rockets, 2 parachute flares, 2 smoke generating devices, 2 navigation torches for each colour (white, green, red, yellow), 1 anchor, 1 floating anchor, 1 pharmacy cabinet with the necessary pharmaceutical and dressing material for the provision of first aid, portable fire extinguishers (foam, powder, carbon dioxide CO2, one each), 1 floatation device, 1 circular lifebuoy with automatic lighting device, 2 parallel rulers, 2 compasses, 2 nautical charts, 1 magnetic com-pass, and 2 rescue signal boards).

Stage A - The interested person shall have taken measures in the school premises against fire hazards.

Stage A - The interested person shall own at least 2 professional boats (Rigid Inflatable Boats – RIBs made of polyester). Each of those shall: - Have a total length of 5-10 meters - Possess a valid sailing licence - Be equipped with a Quick-stop system - Satisfy the provisions of the CE legislation (Submission of compliance statements for the vessel and the engine) - Bear on both sides the signs: “ΕΚΠΑΙΔΕΥΤΙΚΟ - Training Boat” - Be insured as training vessels in accordance with applicable provisions. - No more than 15 years shall have passed since their registration in the Small Vessel Registration Books (BEMS). If more years have passed, the boats may still be used, provided that every year an Attestation by an Authorized Body or a qualified engineer or qualified naval engineer is submitted, stating that propulsion engines still meet the requirements of the applicable regulations and provisions and are operating in a satisfactory condition.

Stage A - Ownership title or leasing contract for the premises, validated by the Tax Authority.

Stage A - Theoretical and practical training in at least 12 one-hour courses (6 one-hour theoretical of at least 45 minutes each and 6 one-hour practical of which two performed in the open sea outside the port entry points). The practical courses include in short: • Basic knowledge of Maritime Law • Internal Regulations to avoid collisions • General Port Regulation for small vessels • PD 31/2018 (GG 61/A/2018) • Basic knowledge of shipping

Stage A - The interested person, if he/she is also a trainer, or the trainer shall hold a certificate of speedboat aptitude.

Stage A - If the interested person and the trainer (if they are different persons) is a citizen of a EU or EEA member-state or of a third country, they shall submit a certificate of at least first level proficiency in Greek.

Stage A - The interested person shall be a Greek citizen or a citizen of another EU member-state or be entitled to practice the profession of lifeguard in Greece.

Stage A - If the trainer is a different person from the interested one, he/she shall be a Greek citizen, shall have completed the twenty-third (23rd) year of age and not have exceeded the 55th. The same applies if he/she is the interested person.

Stage 1 - The interested person shall have completed at least the eighteenth (18th) year of age, where, for the calculation of the age, the date of birth is taken into account.

Stage B - The applicant shall have announced the commencement of the business in the competent Local Tax Office (DOY).

After the expiration of the fifty (50) days deadline, it is presumed that the profession is practiced freely (article 3 of Law 3919/2011 (Government Gazette 32 / AD / 02-3-2011). The applicant may request by the competent administrative authority an attestation according to par. 4 ed. c of article 10 of 3230/2004 (Government Gazette 44 / AD / 11-2-2004).
