In order to obtain a licence to establish and operate service stations selling liquid fuel or mixed or pure liquefied gas (LPG) for public use, natural persons or members of companies are required to be either Greek nationals or citizens of Member States of the European Union or of the European Economic Area (EEA). By way of exception, a licence may be granted, on the basis of the provisions of this article, for the establishment and operation of a service station selling liquid fuel or mixed or liquefied gas (LPG) only, to persons of Greek origin from Russia, North Epirus, Turkey and Egypt, as well as to children born to such persons. When submitting supporting documents, persons of Greek origin from Turkey shall also present a valid Aliens Centre residence card, and the card registration number should be entered on the application form. With regard to public limited companies with their registered office in Greece, the nationality of the shareholders shall not be examined. Nationality requirements for the establishment and operation of a liquid fuel service station (Article 23(2) of Presidential Decree 595/1984 (Government Gazette, Series I, No 218) – See ‘Legislation’ Tab.

If it is found at any time that the conditions under which the licence to operate the service station was granted are no longer satisfied, the licence may be withdrawn temporarily, until the deficiencies have been remedied, or definitively, by means of a fully reasoned decision issued by the authority which granted the licence.

Issuance of the operating licence shall not replace other approvals and shall not exempt the licence holder from the obligation to issue licences or procure other administrative acts required under other provisions and relating to equipment or parts thereof used at the service station.

Before any certificate expires, the licence holder shall be required to submit a new, valid supporting document to the competent department of the authority in order to continue operating. In this case, a new operating licence will not be issued; the service station file record will be updated with the new supporting document. In this case, the check by the authorising authority shall be limited only to the new supporting document submitted. If it is found that a service station is operating without any of the certificates submitted as supporting documents being valid, the operating licence shall be withdrawn and the premises of the service station shall be sealed.

If there is evidence that further operation of the service station is not possible, either because adverse traffic conditions have arisen in the meantime (such as widening or changing the road level, construction of a nearby junction) or for reasons that render its operation objectively impossible (such as demolition, decrease of plot area) or in the cases provided for in Article 185(2) and (3) of Law 4070/2012 (Government Gazette, Series I, No 82), the authorising authority may temporarily or definitively prohibit the continued operation of the service station by means of a specific reasoned decision.

    Note
    Where the applicant is a legal person, the application, together with the legitimation documents required in each case, shall be submitted by its legal representative. 1. In order to obtain a licence to operate a public- or private-use liquid fuel service station, the following supporting documents shall be submitted to the licensing authority, either in Greek or officially translated into Greek (see circular ref. No ΦΒ1Α/70678/764/16-12-2019, Online Publication No: Ω5ΧΖ465ΧΘΞ-ΩΨΤ). 2. All of the following supporting documents, save fees sought ex officio by the licensing authority, shall be submitted with the application. Verification of identity shall not be required for the supporting documents mentioned below. 3. Licence to operate a public- or private-use liquid fuel service station. The application may be submitted digitally when the liquid fuel service station is established within the administrative boundaries of the Region of Attica. (Verification through use of TAXISnet codes by the REGION OF ATTICA, UNIT OF DIGITAL REQUESTS, CITIZEN AND ENTERPRISE SERVICES). In all other Regions, interested parties shall contact the Region in question to learn whether a digital licensing portal has been created.

Copies of these documents shall also be kept in the file of the service station, and a summary table of these documents is being submitted; iii) the construction works of the service station were implemented in accordance with the approved plans, the design for the allocation of anti-explosive areas, the technical reports and the plans of the establishment licence and the building permit, as well as national and European standards and regulations; iv) all technicians, foremen and assistants engaged for the construction of the service station hold the occupation exercise notice permits or attestations required, where provided for by the legislation in force, in accordance with the relevant national or European standards.’Solemn Declaration

If the operation of a service station granted an establishment licence without an operating licence is transferred or leased or otherwise ceded to another person (whether natural or legal), the operating licence shall be granted to the new person within 15 working days from the date of submission of the relevant application. 2. Depending on their use, liquid fuel service stations are distinguished into: a) ‘private-use service stations’, used by the natural or legal person with the right to operate them in order to serve vehicles belonging to this person. Such service stations may be established if the number of vehicles exceeds 20, with the exception of the service stations referred to in Article 22(4) of Presidential Decree 1224/1981, for which there is no numerical limitation; and b) ‘public-use service stations’, used to serve vehicles belonging to anybody and to provide services, sell products and engage in various other activities.
