Description

The procedure concerns the granting of a licence for professional sellers in Farmer’s markets to a natural person to sell their products in a farmer’s market. A professional seller is a natural person who engages in outdoor commerce by making available for sale the items specified by a decision of Article 66(2) of Law 4849/20221 (Government Gazette, Series I, No 207), which are not produced by them. Licences shall be granted following a notice issued by the Regions. Licensees shall be selected through the award of criteria points, which are laid down in Article 16 of Law 4849/2021.

Conditions

The applicant shall commence a professional activity and use a cash register, declared and connected to the Information System of the Independent Authority for Public Revenue (TAXIS).

The applicant must have tax clearance.

The applicant must have insurance clearance.

The applicant shall submit a valid vehicle registration certificate and a valid Technical Control Suitability (MOT) certificate of the vehicle declared for use (own vehicle or other).

The applicant shall be awarded points based on certain criteria, as specified in Article 16 of Law 4849/2021 (Government Gazette, Series I, No 207).

The applicant shall submit a valid health certificate in accordance with Decision Υ1γ/Γ.Π./οικ. 35797/04.04.2012 (Government Gazette, Series II, No 1199) of the Minister for Health and Social Solidarity.

    The applicant shall include in their application the information of Article 4(1)(aa) to (ag) of Ministerial Decision 55332/27.05.2022 (Government Gazette, Series II, No 2660): (aa) ID Card information; (ab) Tax Identification Number (TIN); (ac) Social Security Number (AMKA) (ad) the items sold; (ae) the registration number of the vehicle to be used (own vehicle or other); (af) the positions for exercising activity for sellers in farmer’s markets and the spot or areas of activity for ambulant (itinerant) trade; (ag) a solemn declaration of Law 1599/1986 (Government Gazette, Series I, No 75) stating that they do not hold any other outdoor trading licence.

Any person having a legitimate interest may raise an objection against the decision on the results of the notice before the competent authority within fifteen (15) days from the date the results are published. The decision of the competent authority on the objection shall be issued within ten (10) days from the day it was filed. An appeal may be filed against the decision on the objection by any person that has a legitimate interest in accordance with Articles 63 to 70 of Law 2717/1999 (Government Gazette, Series I, No 97) on the Code of Administrative Procedure before the competent administrative court of first instance.

Remarks

In accordance with Article 26 of Law 4849/2021, as amended by Article 28 of Law 4933/2022 (Government Gazette, Series I, No 99), the competent bodies for issuing a notice, as well as for issuing and granting a licence to a professional seller in farmer’s markets with the corresponding positions in farmer’s markets are the Regions of Greece.
