Description

The procedure concerns the licensing of the establishment of Elderly Care Units of a profit-making nature. It is addressed to companies and legal persons.

The interested party shall not have been irrevocably sentenced to any sentence, for a felony or for any of the misdemeanours of theft, embezzlement, fraud, extortion, forgery, defamation, falsification or violation of drug law, or for any crime relating to the mores, nor have been deprived of his/her civil rights due to any punishable act and for as long as this deprivation lasts.

Issue of building licence in accordance with circular 98 of the Ministry of Infrastructure and Transports with document reference number (“protocol number”) oik 82070/22-12-1989 on the preparation of studies, as it is in force each time.

Observance of the provisions of article 5 of the General Building Regulation Law 1577/1985, as amended and in force, regarding the building licence for new use. In the case of an arrangement or expansion to an existing building, the legality of the building shall be documented, according to article 23, par.1 of the General Building Regulation (Law 1577/1985) as in force.

The plot of the ECU shall meet the conditions on land usage of the urban planning legislation in force; it shall be at least 300m away from the perimeter of an approved industrial zone, noisy workshops and generally unsanitary and annoying facilities, as these are characterized by the competent Committee established by law, in accordance with sanitary provisions in force and it shall be served by the drinking water, electricity, and telephone networks.

The ECUs are subject to the provisions: 1. Of the Building Regulation in Usage class “Health and Social Welfare”. 2. Of the New Building Fire Protection Regulation in usage class “Use H” 3. The design and configuration of the ECU spaces shall take into account the “Regulation on the elimination of architectural obstacles from Health and Welfare buildings, to facilitate their usage by disabled persons and persons of reduced mobility”.

The possibility and adequacy of water and electricity supply, telephone connection and drainage. 4. The table of finishings of the spaces and, more generally, the construction mode of the building and the number of persons being served by the ECU, as well as a complete functional description.

Tacit approval

In case no response has been provided before the above deadline, it is considered that the application of the interested party has been implicitly accepted (tacit approval) and the license has been issued, according to par. 4 of article 14 of Law 3844/2010 (GG 63/A/2010). The applicant, in the aforementioned case of tacit approval, may request a relevant certificate from the administrative authority responsible for issuing the act, in accordance with paragraph 4 of article 10 of 3230/2004 (Government Gazette 44/A/2004).
