Description

The procedure refers to the authorisation of undertakings for the manufacturing, modification, assembling, processing or repairing of firearms within the national territory, provided that the stipulated requirements for the establishment and operation of the relevant undertakings are met. The manufacturing, modification or assembling of category A firearms and long-barrelled firearms of category B (other than weapons for shooting or hunting) is prohibited. The procedure is addressed to undertakings.

The applicant must have a valid firearms trading licence

In the case of a sole proprietorship, there must be no incompatible capacity on the part of the applicant. In the case of a legal person, this requirement applies to all the representatives and managers (for SAs and LLCs) or general partners (for general or limited partnerships).

In the case of a sole proprietorship, the applicant must not be suffering from or have been hospitalised for a major mental disorder or serious personality disorder. In the case of a legal person, this requirement applies to all representatives and managers (for SAs and LLCs) or general partners (for general or limited partnerships).

In the case of a sole proprietorship, the applicant must not have been irrevocably convicted of (a) any misdemeanor prosecuted ex officio and committed with intent, for which a prison sentence of at least 2 years was imposed and (b) any misdemeanor provided for by the provisions of Law 2168/93 and Law 3500/2006. Also, the applicant must not have been prosecuted for (a) acts punishable as a felony, (b) violations of the laws on drugs and protection of society from organised crime, terrorist acts, violations of provisions concerning fishing with explosives or toxic substances and violations of Article 15 of Law 2168/93, (c) acts provided for in Law 3500/2006. In the case of a legal person, this requirement applies to all representatives and managers (for SAs and LLCs) or general partners (for general or limited partnerships).

There must be a licensed site - factory or workshop, which must meet all urban planning obligations as well as safety measures for its safe operation and the safe storage of the firearms produced.

For manufactured firearms, their suitability must be certified and evidenced by a certificate.
